Mijas family to demolish their property

A Mijas family has decided to demolish their new property which was being built illegally in the municipality of Mijas, claiming that there was no other solution to their problem. Dolores Quero told the La Opinion de Málaga newspaper that luckily they had only got as far as building the structure of the building, otherwise it would have been far worse.

Even though they had not been served with a demolition order the family were facing fines of 4,000 € a month over the past year, and took the decision to end the problem only after earlier turning to obtain more credit. The family is aware that they have not complied with the law, but say that ‘public administration have not helped them with their problems, the Town Hall, if they knew this would happen, should not have given them permission to build, claiming that the Councillor for Town Planning told them the only way to build was to ‘torear legality’ (take a risk).

They say they had met with the Mayor from when the problems started, after they were denounced for the structure by their neighbours, in an attempt to find a solution.
Even though now the house is gone, that does not mean that the fines for building it on rustic land will not continue.

Police arrest bogus doctor in Mijas

The local Mijas Police have arrested a local 42 year woman who was acting as a bogus doctor. The 42 year old woman is suspected of a series of recent robberies has been arrested in Mijas.

It is alleged that the suspect, disguised her self in a white lab coat and with a stethoscope draped around her neck, sneaked into at least four local health centres in Mijas and Fuengirola to steal items such as wallets, cash and other valuable items from staff changing rooms and patients.

Mijas information day for foreigners

Mijas Ayuntamiento has organised a conference day designed to give information to foreign residents from Mijas and the Mijas Costa. Some of the items included in the programme range are a look at Spanish legislation and tax system to the plans for the new Mijas marina.

Also some 50 pictures of Mijas never seen before and dating from the 50’s will be on show. The day will be held in CioMijas building on Friday April 25th, and will be opened by the Mayor, Antonio Sánchez at 11am.

Unicaja savings bank is also taking part in the programme which includes a lunch for the 200 or so participants. More details from Mijas Town Hall and from www.ciomijas.com

La Cala Golf Resort is the Best

We new knew all along, but to others it may come as a surprise that the Mijas Costa boasts the largest golf resort in Spain bar none. The 1,000 acre La Cala Golf Resort situated between the Sierra de Mijas National Park and the Mediterranean has just been named by the Royal Spanish Golf Federation as the largest golf resort in Spain for the third consecutive year.

With three 18-hole golf courses, Campo America, Campo Asia and Campo Europa, All designed by Cabell B Robinson and a David Leadbetter Golf Academy with driving range, video analysis, putting green and a six-hole par three short game practice facility, it’s fitting that La Cala Resort also acts as the winter headquarters for a number of European golf federations.

More bilingual education on the Mijas Costa

More classes are to be taught in English as more schools local join the scheme.
A third of the colleges and institutes on the Costa de Sol will be bilingual from the next academic year. The new institute at Las Lagunas, Mijas Costa has applied to join the scheme which will see two subjects taught in a foreign language, usually English.

Along the Costa del Sol more than 7,300 pupils public education in Fuengirola, Mijas and Benalmádena will combine their classes in Castellano and English from September 2008.

Sand to be taken from La Cala de Mijas

The Coasts Department plans to take sand from the sea bottom in La Cala de Mijas

The Coasts Department plans to begin taking sand from the sea bed itself over the coming weeks. According to the experts, the sand will be dredged from an area of the sea floor that has excess sand. The area in question is close to La Cala de Mijas on the Mijas Costa, and studies carried out over a period of time show that there is no marine flora or fauna in this sandy underwater area. The first step is to publish the plans publicly, and a period of time is then set aside for objections to the plan. Expected to object are some environmental groups, non-government organisations and some local politicians.

The sand will be loaded into boats to be brought to the beaches in need of it. This sand is of the highest quality, and is, of course, compatible with the sand already on the beaches in the area. But ángel González, head of the Coasts Department, insists that this process will not replace the taking of sand from the river beds. The sea bed, he says, is simply another source of high-quality sand.

Tax Rebate For Spanish Property Investors

Thousands of Brits who have sold property in Spain over the last few years could be owed a tax rebate of around £11,000 each.

The Britons who made capital gains by selling Spanish property, could be in line for a 20 per cent tax rebate.

Anyone who sold their home between March 2004 and December 2006 could benefit, as the result of a Spanish Government Capital Gains Tax scam exposed by Spanish lawyers Costa, Alvarez, Manglano & Associates, and currency exchange brokers HiFX.

The law firm is now planning on taking the Spanish government to the European Court of Justice, after discovering that until 2007 a capital gains charge of 35 per cent was levied on property sold by non-Spaniards, despite the fact that the charge was just 15 per cent for Spanish sellers.

The total amount of compensation payable could amount to around £50m, and HiFX believes around 4,500 British people could have been affected, as well as thousands more from other countries. It is thought the average amount of capital gains tax paid on each property sold was around £14,000.

Thousands more people who sold their homes in Spain before 2004 may also have lost money, but they have already missed out as claims can only date back over a four-year period.

Spanish Lawyer Emilio Álvarez told the website Easier.com: "Anyone who has sold a Spanish property between March 2004 and December 2006 will have been victim to this inflated capital gains tax rate, which saw non residents scammed into paying inflated CGT bills by as much as 20 per cent. This tax trap is thought to have affected hundreds of thousands of people across Europe and in the UK.

"A change in the law at the start of 2007, which saw the standard Capital Gains Tax for non residents being brought in line – a reduction from 35 per cent to 15 per cent , passed by largely unnoticed. As a result, thousands of people who had previously sold property in Spain are entitled to a 20 per cent rebate, thought to average at £11,000 each, including interest. Due to stringent legal restrictions people who bought at the end of 2003 have already missed out, as claimants must register within four years, but thousands of Brits can still join forces and fight to get the Spanish tax authorities to pay back the money owed."
